A. Right of Withdrawal Information

Introduction
Consumers are entitled to a right of withdrawal under the following conditions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Janusz Strzalkowski, Atelier Galerie, Hofgartensiedlung 29, 3484 Grafenwörth, Austria, Tel.: +43 699 117 87 620, Email: janus@check.at) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or email). You may use the attached model withdrawal form, which is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you all payments received from you, including delivery costs (except for the additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your notice of withdrawal. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods. For goods that cannot be returned normally by post due to their nature (freight forwarding goods), these return costs are estimated at a maximum of approximately €100 per item.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to consumers who, at the time the contract was concluded, are not nationals of a Member State of the European Union and whose sole place of residence and delivery address are located outside the European Union at the time of contract conclusion.

General Information

  1. Please avoid damaging or contaminating the goods. Please return the goods in their original packaging with all accessories and all packaging components. Use a protective outer packaging if necessary. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.

  2. Please do not return goods to us freight collect.

  3. Please note that the above points 1–2 are not a prerequisite for the effective exercise of the right of withdrawal.
